1. Spores

Spores are the in-game currency of InfectUs. You earn them in the game, for example through symptoms, or buy them in packs in the shop; they are virtual items under Section 7 of the Terms of Service. You can spend them in the game on what the shop offers, such as parts for your virus, a new name, your own motto, moving a hotspot or special cards. The price is shown before you spend them and deducted when you confirm; Spores you earned are used before those you bought.

2. Prices & Payment

Packs are offered in euro. The price shown is the final price, including any applicable VAT, and is the amount charged. Payments are processed by Stripe with the methods offered at checkout (such as card, Apple Pay, Google Pay, PayPal, Klarna or EPS); we never receive or store your payment details. The contract is concluded when you complete the payment at checkout.

3. Delivery

Purchases are credited to your account as soon as the payment is confirmed, normally within seconds. Some payment methods settle more slowly; in that case the purchase appears once your bank or provider confirms the payment. After each purchase we send you a confirmation by email with the pack, the Spores, the price, the order number, your waiver of the right of withdrawal and the information on the right of withdrawal below.

4. Refunds & Chargebacks

Beyond your statutory rights and the refunds under Sections 7 and 11 of the Terms of Service (if we end your account without a breach, discontinue the game or reset Spores you bought), purchases are non-refundable once delivered. If something goes wrong with a payment (you were charged and received nothing, or were charged twice), contact us and we will put it right. If a payment is refunded, we take back the Spores of that purchase as far as they are still on your account; what you already spent them on stays. If you reverse a payment through your bank or card provider (chargeback), we hold back the Spores of that purchase as soon as the money is withdrawn from us, again only as far as they are still on your account; if the case is decided in your favour, you get them back, otherwise they stay withdrawn. Reversing a payment without a valid reason is a breach of these Terms of Sale.

5. Minors

If you are under 18, you may only buy Spores with the consent of a parent or guardian.

6. Information on the Right of Withdrawal

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason. The withdrawal period will expire after fourteen days from the day of the conclusion of the contract.

of your decision to withdraw from this contract by an unequivocal statement (for example an email). You may use the model withdrawal form below, but it is not obligatory. To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

Early expiry of the right of withdrawal

Spores and the other virtual goods of InfectUs are digital content that is not supplied on a tangible medium. For such a contract, your right of withdrawal expires once we have begun to perform the contract after you have expressly consented that we begin before the end of the withdrawal period, acknowledged that you thereby lose your right of withdrawal, and received our confirmation of this (§ 18 (1) no. 11 FAGG).

How this works in the game. Before you pay, the checkout asks you to tick the box “I request immediate delivery of my spores and acknowledge that I thereby lose my statutory right of withdrawal for this purchase.” Without the tick, the purchase cannot be completed. Your Spores are credited as soon as the payment is confirmed, and your purchase confirmation by email repeats your consent in its wording. We store the time, the language and the version of the wording together with your order.

If your Spores were not credited, for example because a payment method settled too slowly or something went wrong, your right of withdrawal remains: write to us and we will put it right or refund you.

1. Sporen

Sporen sind die Spielwährung von InfectUs. Du verdienst sie im Spiel, etwa über Symptome, oder kaufst sie in Paketen im Laden; sie sind virtuelle Gegenstände im Sinne von Abschnitt 7 der AGB. Du kannst sie im Spiel für das ausgeben, was der Laden anbietet, etwa Teile für deinen Virus, einen neuen Namen, einen eigenen Spruch, das Umsiedeln eines Hotspots oder Sonderkarten. Der Preis steht da, bevor du sie ausgibst, und wird abgezogen, wenn du bestätigst; verdiente Sporen werden vor gekauften verbraucht.

2. Preise & Bezahlung

Pakete werden in Euro angeboten. Der angezeigte Preis ist der Endpreis, einschließlich einer gegebenenfalls anfallenden Umsatzsteuer, und ist der abgebuchte Betrag. Die Zahlungsabwicklung erfolgt über Stripe mit den an der Kasse angebotenen Zahlungsarten (etwa Karte, Apple Pay, Google Pay, PayPal, Klarna oder EPS); wir erhalten und speichern deine Zahlungsdaten nie. Der Vertrag kommt zustande, wenn du die Zahlung an der Kasse abschließt.

3. Lieferung

Käufe werden deinem Konto gutgeschrieben, sobald die Zahlung bestätigt ist, in der Regel innerhalb von Sekunden. Manche Zahlungsarten werden langsamer abgewickelt; der Kauf erscheint dann, sobald deine Bank oder dein Anbieter die Zahlung bestätigt. Nach jedem Kauf schicken wir dir eine Kaufbestätigung per E-Mail mit Paket, Sporen, Preis, Bestellnummer, deinem Verzicht auf das Widerrufsrecht und der Widerrufsbelehrung unten.

4. Erstattungen & Rückbuchungen

Über deine gesetzlichen Rechte und die Erstattungen nach den Abschnitten 7 und 11 der AGB hinaus (wenn wir dein Konto ohne Verstoß beenden, das Spiel einstellen oder gekaufte Sporen zurücksetzen) sind Käufe nach der Lieferung nicht erstattungsfähig. Sollte bei einer Zahlung etwas schiefgehen (es wurde abgebucht, aber nichts geliefert, oder doppelt abgebucht), melde dich bei uns und wir bringen das in Ordnung. Wird eine Zahlung erstattet, nehmen wir die Sporen dieses Kaufs zurück, soweit sie noch auf deinem Konto sind; wofür du sie schon ausgegeben hast, bleibt dir. Buchst du eine Zahlung über deine Bank oder deinen Kartenanbieter zurück, behalten wir die Sporen dieses Kaufs ein, sobald uns das Geld entzogen wird, wieder nur, soweit sie noch auf deinem Konto sind; entscheidet die Bank zu deinen Gunsten, bekommst du sie zurück, sonst bleiben sie weg. Eine Zahlung ohne berechtigten Grund zurückzubuchen, ist ein Verstoß gegen diese Verkaufsbedingungen.

5. Minderjährige

Bist du jünger als 18 Jahre, darfst du Sporen nur mit Zustimmung eines Elternteils oder einer erziehungsberechtigten Person kaufen.

6. Widerrufs­belehrung

Widerrufsrecht

Du hast das Recht, binnen vierzehn Tagen ohne Angabe von Gründen diesen Vertrag zu widerrufen. Die Widerrufsfrist beträgt vierzehn Tage ab dem Tag des Vertragsabschlusses.

mittels einer eindeutigen Erklärung (zum Beispiel einer E-Mail) über deinen Entschluss, diesen Vertrag zu widerrufen, informieren. Du kannst dafür das unten stehende Muster-Widerrufsformular verwenden, das jedoch nicht vorgeschrieben ist. Zur Wahrung der Widerrufsfrist reicht es aus, dass du die Mitteilung über die Ausübung des Widerrufsrechts vor Ablauf der Widerrufsfrist absendest.

Folgen des Widerrufs

Wenn du diesen Vertrag widerrufst, haben wir dir alle Zahlungen, die wir von dir erhalten haben, unverzüglich und spätestens binnen vierzehn Tagen ab dem Tag zurückzuzahlen, an dem die Mitteilung über deinen Widerruf dieses Vertrags bei uns eingegangen ist. Für diese Rückzahlung verwenden wir dasselbe Zahlungsmittel, das du bei der ursprünglichen Transaktion eingesetzt hast, es sei denn, mit dir wurde ausdrücklich etwas anderes vereinbart; in keinem Fall werden dir wegen dieser Rückzahlung Entgelte berechnet.

Vorzeitiges Erlöschen des Widerrufsrechts

Sporen und die übrigen virtuellen Güter von InfectUs sind digitale Inhalte, die nicht auf einem körperlichen Datenträger geliefert werden. Bei einem solchen Vertrag erlischt dein Widerrufsrecht, sobald wir mit der Vertragserfüllung begonnen haben, nachdem du ausdrücklich zugestimmt hast, dass wir vor Ablauf der Widerrufsfrist damit beginnen, deine Kenntnis davon bestätigt hast, dass du dadurch dein Widerrufsrecht verlierst, und wir dir dies bestätigt haben (§ 18 Abs. 1 Z 11 FAGG).

So läuft das im Spiel. Vor dem Bezahlen bittet dich die Kasse, das Kästchen „Ich verlange die sofortige Gutschrift meiner Sporen und nehme zur Kenntnis, dass ich dadurch mein gesetzliches Widerrufsrecht für diesen Kauf verliere.“ anzuhaken. Ohne den Haken lässt sich der Kauf nicht abschließen. Deine Sporen werden gutgeschrieben, sobald die Zahlung bestätigt ist, und deine Kaufbestätigung per E-Mail wiederholt deine Zustimmung im Wortlaut. Zeit, Sprache und Fassung des Wortlauts halten wir mit deiner Bestellung fest.

Wurden deine Sporen nicht gutgeschrieben, etwa weil eine Zahlungsart zu langsam war oder etwas schiefging, bleibt dein Widerrufsrecht bestehen: Schreib uns, und wir bringen das in Ordnung oder erstatten dir den Betrag.
